You are trusting us with more than an order. You are trusting us with your name, your address, and information about the children in your life. We take that seriously.
This policy explains what ModernTots collects, why we collect it, who we share it with, and what control you have. We have written it in plain language, because a privacy policy you cannot understand is not really a privacy policy.
This policy applies to moderntots.com and to our email communications. It does not cover Etsy, which operates under its own privacy policy when you shop through our Etsy storefront.
Who We Are
ModernTots is a small family business in Corydon, Indiana, making children’s furniture since 2009. When this policy says “we,” “us,” or “our,” it means ModernTots.
Information We Collect
Information you give us
- Order information: your name, shipping address, billing address, email address, phone number, and order details.
- Payment information: handled by our payment processors. We never see or store your full card number.
- Account information: if you create an account, your login credentials and saved preferences.
- Email signups: your email address, and your first name if you share it.
- Messages you send us: anything you include when you contact us with a question, a photo, or a review.
- Blog comments: if you comment on a post, we collect the name, email address, and comment content you submit, along with your IP address for spam filtering.
- Personalization details: a child’s first name or initials if you order a personalized product. We use this to make your item and to fulfill your order, nothing else.
Information collected automatically
When you visit our site, we and our analytics and advertising partners may collect:
- IP address and general location (city or region level)
- Browser type, device type, and operating system
- Pages viewed, links clicked, time on page, and the site you arrived from
- Cookie and pixel identifiers
Cookies, Analytics, and Advertising
We use cookies and similar technologies to keep the site working, understand how people use it, and reach people who may be interested in what we make. Specifically:
- Essential cookies: set by WordPress and WooCommerce so the cart, checkout, and account login work. These cannot be turned off without breaking the store.
- Google Analytics: helps us understand which pages are useful and where visitors get stuck.
- Meta (Facebook and Instagram) Pixel: measures ad performance and allows us to show ads to people who have visited our site or who resemble our customers.
- Pinterest Tag: measures ad performance and supports similar advertising features.
Under some state privacy laws, sharing information with advertising partners in this way is considered “sharing” for cross-context behavioral advertising. We do not sell your personal information for money, and we never share information about specific children with advertisers.
How to opt out
- Adjust cookie settings in your browser, or browse in private mode.
- Install the Google Analytics Opt-out Browser Add-on.
- Manage ad preferences in your Meta account settings and your Pinterest privacy settings.
- Use industry opt-out tools at optout.aboutads.info or optout.networkadvertising.org.
We honor Global Privacy Control (GPC) signals sent by your browser as an opt-out request where required by law.
How We Use Your Information
- To process, build, and ship your order
- To send order confirmations, shipping updates, and delivery notifications
- To answer your questions and resolve problems with an order
- To send care instructions, assembly guidance, and product information related to what you bought
- To send marketing emails, if you have asked to receive them
- To invite reviews and feedback after delivery
- To improve our products, our site, and our customer service
- To detect fraud and protect the security of our site
- To meet tax, accounting, and other legal obligations
There are two kinds of email we send, and the difference matters.
Transactional email relates directly to an order you placed: confirmations, shipping notices, delivery updates, care and assembly information, and support replies. These are part of fulfilling your purchase.
Marketing email includes new product news, ideas for play, and occasional offers. We only send these if you have signed up. Every marketing email includes an unsubscribe link, and unsubscribing takes effect right away. You can also reply to any email and ask us to remove you, and we will take care of it.
Unsubscribing from marketing email does not stop transactional email about an order already in progress.
Who We Share Information With
We do not sell your personal information. We share it only with the service providers who help us run the business, and only as needed to do their job:
- Our website: moderntots.com runs on WordPress with WooCommerce and is hosted by SiteGround, which stores our site and order data
- Etsy: hosts our Etsy storefront and processes those orders under its own privacy policy
- Payment processors: Stripe and PayPal, which authorize and complete payments securely
- Shipping and fulfillment: ShipStation, along with carriers such as UPS, FedEx, and USPS, to deliver your order
- Email platform: Omnisend, which sends our order and marketing email
- Automation tools: Make, which moves order information between the systems above
- Analytics and advertising partners: Google, Meta, and Pinterest, as described above
We may also disclose information when the law requires it, when we need to protect our rights or someone’s safety, or in connection with a sale or transfer of the business. If ownership of ModernTots ever changes, we will notify customers before their information moves to a new owner.
Where Your Information Is Stored
ModernTots operates in the United States and sells to customers in the United States and Canada. Your information is stored and processed on servers in the United States. If you are ordering from Canada, your information will be transferred to and processed in the United States.
How Long We Keep It
- Order records: at least seven years, as required for tax and accounting purposes
- Email subscribers: until you unsubscribe, and for a short period afterward to make sure the unsubscribe holds
- Support conversations: generally three years, so we can help with warranty or replacement questions
- Blog comments: kept indefinitely so conversations stay readable, unless you ask us to remove yours
- Analytics data: according to each platform’s retention settings, typically 14 to 26 months
How We Protect It
Our site uses SSL encryption. Payments are processed through PCI-compliant providers, and full card numbers never touch our servers. Access to customer information is limited to the people who need it to fill orders and answer questions. No system is perfectly secure, and we will not pretend otherwise, but we take reasonable steps to protect what you share with us.
Your Choices and Rights
You can ask us to:
- Tell you what personal information we have about you
- Correct information that is wrong or out of date
- Delete your information, subject to records we are legally required to keep
- Stop sending you marketing email
- Stop sharing your information for advertising purposes
Email us at privacy @moderntots.com and we will respond within 30 days. We will never charge you or treat you differently for exercising these rights.
California residents
Under the California Consumer Privacy Act, as amended, California residents have the right to know what personal information we collect and how we use it, to request deletion or correction, to opt out of the sale or sharing of personal information, and to be free from discrimination for exercising these rights. We do not sell personal information. To opt out of sharing for targeted advertising, use the methods listed in the cookies section above or email us directly. An authorized agent may submit a request on your behalf with written proof of authorization.
Other state privacy laws
Residents of states with comparable privacy laws, including Colorado, Connecticut, Virginia, Texas, Oregon, and others, have similar rights. Contact us using the information below and we will honor your request.
Canadian residents
Under Canada’s Personal Information Protection and Electronic Documents Act, you may request access to the personal information we hold about you and ask for corrections. Use the contact information below.
Children’s Privacy
We make products for children, but this website is intended for adults. We do not knowingly collect personal information from anyone under 13. If you believe a child has provided us with personal information, contact us and we will delete it promptly.
When you order a personalized product, any child’s name or initials you provide is information you have chosen to share with us as the adult purchaser. We use it only to make and ship your item.
Reviews and Photos
If you share a review, a photo, or a comment with us, you are giving us permission to display it on our website, in our email, and on our social media, along with your first name and last initial. If you would like something you shared removed, email us and we will take it down.
Links to Other Sites
Our site and email may link to other websites, including Etsy, Pinterest, and social media platforms. Once you leave moderntots.com, this policy no longer applies. We encourage you to read the privacy policy of any site you visit.
Changes to This Policy
We may update this policy as our business or the law changes. When we do, we will update the date at the top of this page. If a change meaningfully affects how we handle your information, we will let subscribers know by email.
